TERMS AND CONDITIONS

for the provision of genealogical services
issued in accordance with Section 1751 et seq. of Act No. 89/2012 Coll., the Civil Code

2. Scope and Procedure of Cooperation

  1. You can contact us if you wish to have a family tree or a family book compiled, or if you need assistance or advice with a specific genealogical problem or the reading of old texts. More detailed information about our services is available on our website.
  2. If you are interested in our services, please reach out to us via the contact form on our website, by e-mail at hello@myczechancestors.com, or by phone using the number provided above. Let us know which services you are interested in, and we will agree on the next steps. It is possible to arrange an in-person meeting at our office in Brno or an online video call; otherwise, all communication can take place by e-mail.
  3. Based on your request, we will ask you for more detailed information and documents in order to conduct an initial assessment and prepare a cooperation proposal, including a detailed price quotation. This quotation will be sent to you for review, and we will be happy to answer any questions you may have.
  4. Once the scope of cooperation has been agreed upon, we will send you a binding order for confirmation, which you will then confirm in writing (by e-mail). By confirming this order, you acknowledge that you have read and agreed to these Terms and Conditions.
  5. After confirmation, we will issue a deposit invoice amounting to 30 % of the total order value. Work on your project will commence once the deposit has been paid.

3. Price and Payment Terms

  1. The price of our services is determined individually based on the scope of cooperation. It is always agreed in advance as the maximum budget, which may be exceeded only with your prior approval. This budget limit is specified both in the initial quotation and in the binding order.
  2. In the case of compiling a family tree or a family book, the fee for our services is performance-based. This means that if, for any reason, a particular record cannot be located, the price will be proportionally reduced.
  3. Prices are quoted in euros (EUR) or US dollars (USD).
  4. We are not VAT payers.
  5. Before the start of cooperation, you will pay a deposit of 30 % of the total amount based on a proforma (advance) invoice issued by us.
  6. The remaining balance is due within 7 days after the delivery of the digital outputs. Along with the final results of our work, you will receive a final invoice in electronic form.
  7. Payments are made by bank transfer to our account.
  8. After receiving the processed digital version of your family tree or family book, you may wish to add or modify some details. We take this into account — one round of such revisions is already included in the final invoiced price (i.e., no extra charge).
  9. In addition to the agreed price for the digital processing of the family tree and family book, there may be additional costs for administrative fees or travel expenses. If such costs would increase the total price beyond the approved budget, we will always discuss and approve them with you in advance.
  10. The preparation of physical outputs — in particular printed and bound family books, printed or hand-painted family trees, or video stories of ancestors — is not included in the budget for the digital version of the family tree. Since their price depends on the number of copies, pages, and overall scope, it can only be determined in a separate quotation once the final digital version of the family tree and family book has been completed.

4. Delivery of Services and Outputs

  1. The results of our research are provided primarily in digital form (e.g., PDF, JPG, DOCX, ZIP).
  2. Digital outputs are delivered via e-mail, cloud storage (such as OneDrive, Google Drive, or WeTransfer), or another mutually agreed method.
  3. The printing of posters, books, or other physical products is not included in the service order. Such physical outputs may be ordered only after the digital materials have been finalized and are subject to a separate order. Delivery will take place by the agreed method (most commonly via carriers such as PPL or Zásilkovna, or by personal pickup).
  4. You will always receive the completed outputs within the deadline agreed in your order.

5. Gift Vouchers

  1. If you decide to purchase a voucher (gift certificate) for our services, please contact us in the same way as when requesting any other service.
  2. Together we will agree on the value of the voucher and, if you wish, also on the specific options that can be provided within that amount. We will then prepare a detailed price quotation for these options.
  3. After you approve the quotation, we will send you a binding order for confirmation. If agreed, the order may specify that the scope of cooperation can later be modified by the recipient of the voucher, provided that such changes remain within the value of the voucher and are made before work on the family tree begins.
  4. Once the order is confirmed, we will issue an electronic advance invoice in the amount of 30 % of the total value of the voucher.
  5. The necessary materials can be sent either by you or directly by the recipient. After the voucher has been handed over, all further communication may, if you prefer, take place directly with the recipient. You will be informed once the family tree has been completed, and at that time you will also receive the final statement and invoice (as described in the section above).
  6. Each gift voucher has a limited validity period, which is expressly stated on the voucher itself and in the order. In the event that the voucher is not used within this period, the deposit is non-refundable.

6. Withdrawal from the Contract

  1. If, for any reason, you wish to cancel your service order, you may do so by sending a written notice to our postal address or by e-mail. The effective date of withdrawal shall be the date on which the written notice of withdrawal is received by the other party.
  2. If you withdraw from the order before we begin detailed work on it, we will retain the paid deposit as compensation for the costs incurred in connection with the initial research and allocation of our resources.
  3. If you withdraw after the research has already started, we will immediately stop all work, but we will need to calculate the value of the work already completed. The partial results will be sent to you together with a final statement and invoice for the corresponding amount.
  4. If, for any reason, we have to cancel the order, we will refund the deposit to your bank account within 14 days from the date of withdrawal.
  5. Withdrawal is not possible for orders involving physical products (such as printed family books or family tree posters) once they have been sent to production.

7. Liability and Complaints

  1. We guarantee that our services will be provided with the highest possible level of professional care and expertise. However, due to the nature of genealogical research, it must be understood that it is not always possible to locate every piece of information. As any such missing information is not included in the invoiced price, it cannot be considered a reason for a complaint. Complaints may only concern objectively incorrect or improperly delivered services.
  2. If you have any comments or concerns regarding the delivered product, please contact us by e-mail at hello@myczechancestors.com, specifying what you believe to be the defect and how you suggest it should be corrected.
  3. If you wish to file a complaint concerning a physical product (such as a family book or a family tree poster), please contact us so that we can agree on how the product should be returned or presented for assessment and correction. In some cases, a photograph of the defect may be sufficient.
  4. In accordance with applicable law, we will make every effort to resolve your complaint to the satisfaction of both parties. We may agree on a repair, correction, or replacement (of the physical or digital product). Alternatively, you may request an appropriate discount or, under statutory conditions, withdraw from the contract.
  5. Your complaint will be resolved within 30 days, unless we mutually agree otherwise.
  6. For digital outputs of our work, we provide a six-month warranty period from the date of delivery. If you discover any inconsistencies even after this period, please contact us — we will do our best to find a fair solution even after the warranty expires.

7. Copyright

  1. All texts, graphic designs, diagrams, and research results provided by us constitute our original copyrighted works.
  2. You may use these works for personal and non-commercial purposes only. You may not publish, modify, or combine them with other works without our prior consent.
  3. Any further distribution or commercial use (such as sale or commercial presentation) likewise requires our prior written consent.
  4. In the event that our outputs are published, the brand “Hledání předků.cz” must always be clearly indicated in connection with them.
  5. The right to use our outputs in the ways described above arises only after full payment of the agreed price. Until the work has been fully paid for, you do not have the right to use, share, or otherwise handle the delivered outputs.

8. Protection of Personal Data

Detailed information on the processing of personal data is provided in a separate document entitled “Privacy Policy (GDPR)”, available at www.myczechancestors.com/gdpr.

9. Out-of-Court Dispute Resolution

Under applicable law, you have the right to refer any consumer dispute to the Czech Trade Inspection Authority (www.coi.cz) for out-of-court resolution.

10. Final Provisions

These Terms and Conditions form an integral part of the order for the services provided.
